Judge dismisses lawsuit against NASCAR legend Tony Stewart

Utica, N.Y. (WHAM) -- ESPN reports the wrongful death lawsuit filed by the parents of Kevin Ward Jr. against Tony Stewart was officially dismissed Tuesday.

The lawsuit stems from the death of Kevin Ward Jr., 20, in 2014. Ward was killed after being hit by Stewart's vehicle during a sprint car race at Canandaigua Motorsports Park.

Ward's parents filed a wrongful death lawsuit in 2015, claiming the crash was caused by recklessness on Stewart's part.

According to the report, the judge allowed 30 days for the case to be reopened if the terms of the settlement are not met.

According to the report, the judge allowed 30 days for the case to be reopened if the terms of the settlement are not met.

Many people are thinking Stewart didn't have to pay a dime to the Ward family but the last sentence proves he had to pay something and now both have to agree to the terms.

According to the internet Tony Stewart's net worth is 70 million. Why can't he throw the Ward family a bone.   :(

Throw them a bone? The kid was high....He got out of his car and walked into traffic. He owes them nothing.

I am annoyed about this post. It was a tragic racing accident. Stewart will remember that nite all his life. JUSTICE HAS SPOKEN, Money paid or not doesn't matter to anyone,,, especially us. Things happen during life    and     the rest of us should learn,,,,...

Always easy to spend when it is somebody else's money.

Social commentary time -
Many years ago I participated in some mock trials.  A lawyer would set it up so he could practice for his upcoming cases.  It would be an abbreviated version, and he would change things for different groups of prospective jurors to see how it would resonate with them.

One of the cases involved a plaintiff who was inadvertently shot.  It was in the leg and luckily was a through and through shot.  It did not hit anything of consequence and he did not even need surgery.  After hearing the case the jury unanimously agreed that there was enough culpability and that he should be compensated.  (This was a civil trial).  Jurors were suggesting 10M...5M.  It was out of control.  We eventually "came to a collective" and told the judge 3.5M.  I wish I had audiotaped it because it would have been a great case study for a social experiment.
